Payroll requirements in Florida

Florida has no personal income tax. It does have a state minimum wage and a reemployment tax that employers pay. HR360 TechX does not file either one.

Withholding and unemployment insurance

Do not set up Florida income-tax withholding. Federal income tax, Social Security, and Medicare still apply. The Florida Department of Revenue is the agency for state business taxes, including reemployment tax: Florida reemployment tax.

Minimum wage, overtime, and the final paycheck

FloridaCommerce states that the Florida minimum wage is $15.00 per hour effective September 30, 2026, and that this rate runs through December 31, 2027. Source: Florida minimum wage. A separate cash wage applies to tipped employees; use the figure on that official page rather than a third-party chart.

Florida does not add a general daily overtime statute on top of the FLSA 40-hour rule. Source: DOL overtime.

Florida does not use California’s immediate final-paycheck rule. Pay earned wages on the regular payday and read Chapter 448 with the Department of Commerce poster requirement: Florida Statutes 448.109.

Pay frequency and new-hire reporting

Keep a regular payday and document it. Florida Statutes section 409.2576 requires new-hire information within 20 days of the hire date. Source: Florida Statutes 409.2576.

This is general information for employers, not tax, legal, or payroll-filing advice. Rates and deadlines change. Confirm them with the cited agency before you pay people or file a return.
